Copyrights and Cyberspace
According to the United States Copyright
Office’s extensive online site, www.copyright.gov/:
“Copyright is a form of protection grounded in
the U.S. Constitution and granted by law for original works of
authorship fixed in a tangible medium of expression. Copyright
covers both published and unpublished works.”
While content is copyright protected from the
moment of creation, most feel more secure with registering their
work and thus giving themselves a public record and certificate of
copyright, which will benefit them in case of an infringement
lawsuit.
Copyright protection has both civil and
criminal repercussions. Civil damages can be awarded in excess of
any actual amount earned or profited by the copyright violator. It
is important to realize that U.S. law specifies that felonious
criminal violations of copyrighted material involves more than 10
copies and is valued over $2500.00.
Before the growth and popularity of the
Internet, copyright law frequently dealt with paper copies of books
and magazine articles or cassette copies of music from records or
radio. The Digital Millennium Copyright Act provides both civil and
criminal penalties for violations. For the first offense, violating
this law can be penalized up to $500,000 and 5 years in prison. In
addition, the U.S. has reciprocal agreements with many other nations
and honors the copyright of other countries’ material.
