The criminals are out there wreaking all the
havoc they can muster. The victims know it is happening, but how do
they take advantage of the legal resources that are available? This
topic will be covered in the next section.
Enforcement of Internet Crime Statutes
As a former chief of security for Microsoft
Corporation and longtime soldier in the war against cyber crime,
Howard Schmidt says that most areas of the country have sufficient
laws in place to protect against common forms of cyber crime. The
problem lies in the enforcement of those laws.
Victims of cyber crimes need to be of as much
aid as possible to the law enforcement agencies that will be
handling their case. Make sure every scrap of evidence in whatever
form it may exist is available to investigators. Cyber crimes are
difficult to investigate and prosecute, even when all the pieces are
in place. Victims should be careful not to compound the difficulty
by providing shoddy information. Provide a journal outlining events
and timelines.
As the problems associated with cyber crime
continue to grow, the FBI has intensified its efforts, and has
formed a partnership with IC3 to help facilitate data gathering.
Penalties for Cyber Criminals
The Identity Theft Penalty Enhancement Act
of 2004 was signed into law in July of that year by President
Bush. At the time of the signing, President Bush commented on the
new law, remarking that,
“It reflects our government’s resolve to answer
serious offenses with serious penalties.”
