Local, Regional or International Crimes
Questions of jurisdiction in criminal
proceedings involving Internet crimes are complicated by a number of
factors. The Internet is a global forum, spanning international
jurisdictions, each with their own laws and codes.
To complicate matters further, cyber criminals
are able to spoof e-mail addresses, making it appear that messages
they send are originating from a different address than they
actually are. An e-mail that appears to have been sent from outside
the country may in fact have been sent from across town.
Deciphering the genuine properties of a message
can be a challenge, but it is only the first step in a long chain of
events that may or may not lead to identifying the bad guy. For
cases like this, IC3 may well be the best starting point.
Separate jurisdictions may attach penalties of
differing severity to the same crime. In cases involving financial
loss for example, the level of damage that must be incurred before
the crime is considered a felony can be different from state to
state. Researching which jurisdiction carries the tougher penalty
for a particular crime can result in a more robust sentence. Any
victims of such crimes should contact their state’s Attorney General
to advise the course of action.
In cases with international considerations, the
questions associated with inconsistent penalties can be very
difficult to answer. It is possible for an act to be categorized as
a serious crime in one country, and not even illegal in another.
