Victims’ Rights and
Cybercrimes
Local law enforcement may handle many or all
aspects of the crime, particularly if both the victim and the
criminal are within the same local jurisdiction. If the perpetrator
has committed related crimes in other locales, the law enforcement
agencies associated with those areas will also become involved.
If all offenses related to a string of
violations appear to be contained within a state, most likely state
authorities will oversee the investigation. This is not always the
case, as crimes involving violations of federal laws can involve the
FBI, regardless of other jurisdictional considerations.
When crimes span interstate boundaries, the FBI
and possibly other federal agencies, depending on the nature of the
crimes, will be involved in the investigation.
In some cases, law enforcement agencies
themselves may be unsure how to proceed, especially if they are not
accustomed to handling these sorts of offenses. A victim may be
referred to a special crimes unit, or less satisfactorily, they may
simply take a report and then not act on it at all.
A better option may be to contact the Internet
Crime Complaint Center (www.ic3.gov). Specially trained
staff members will record the details of the crime and refer the
case to the correct law enforcement agency.
